These Terms of Service (the "Agreement") constitute a legally binding contract between you (the "User" or "Customer") and HEVYMOTO. By visiting our website, registering an account, or purchasing motorcycle equipment, you affirm that you are at least 18 years of age or possess legal parental/guardian consent and possess the requisite authority to enter into this contract under the Indian Contract Act, 1872.

If you do not accept these terms in their entirety, you must discontinue the use of our services immediately.

When you create an account on HEVYMOTO, you are responsible for maintaining the confidentiality of your login credentials and for restricting access to your personal devices. You agree to accept liability for all activities that occur under your registered profile.

You must provide accurate, current, and complete information during registration. We reserve the right to suspend or terminate accounts that supply deceptive contact information or violate safety policies.

All prices displayed on HEVYMOTO are denominated in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless explicitly noted otherwise.

We take reasonable care to ensure that all specifications, safety certifications (ISI IS 4151, ECE 22.06, DOT), sizing charts, and product photography are accurate. However, minor variations in graphic decal placements or color tones may occur across production batches. We reserve the right to rectify inadvertent pricing errors prior to dispatch.

An order confirmation receipt generated on checkout signifies receipt of your order request; it does not constitute formal acceptance of the order. Order acceptance and the formation of a sales contract occur when your parcel is physically verified and handed to the courier with an issued AWB tracking number.

HEVYMOTO reserves the right to cancel orders in circumstances of suspected fraudulent activity, pricing discrepancies, stock exhaustion, or unserviceable pin code addresses. In such cases, any prepaid funds will be promptly refunded in full to the original payment source within 3–5 business days.

We accept authorized Indian digital payment methods including Unified Payments Interface (UPI), Credit/Debit Cards, and Net Banking through our PCI-DSS certified gateway partners, as well as Cash on Delivery (COD) for eligible pin codes.

For COD orders, cash must be tendered in full to the logistics delivery agent before unboxing the sealed transit carton. Refusal to accept verified COD packages without valid justification may result in restriction of COD privileges on future orders.

HEVYMOTO provides delivery across 19,000+ Indian postal codes. Standard orders are prepared for dispatch within 24–48 business hours. Estimated delivery timeframes (typically 2–4 business days for metros and 4–6 business days for regional zones) are reasonable projections and may be subject to force majeure, extreme weather, or regional transit restrictions.

Title and risk of loss for items purchased pass to you upon delivery by the courier partner to your designated shipping destination.

We operate a customer-first 30-day return and size exchange policy. To qualify for a size exchange or refund:

• The product must be completely unused and unworn on road rides.
• All original manufacturer packaging, protective visor films, helmet bags, manual booklets, and retail hangtags must remain completely intact.
• The return request must be submitted within 30 days of the verified delivery timestamp.

Products retailed on HEVYMOTO are genuine, original units covered by official manufacturer warranties ranging from 1 to 5 years against material and workmanship defects.

Warranties strictly exclude damage arising from road collisions or accidents, normal cosmetic wear and tear, scratch damage to visors, improper solvent cleaning, or unauthorized modifications. Review our Warranty Policy for claim procedures.

The HEVYMOTO wordmark, logos, custom typography, site architecture, and digital media are the proprietary intellectual property of HEVYMOTO. Partner brand trademarks (including Axor, SMK, MT, LS2, etc.) belong to their respective corporate proprietors and are utilized strictly with authorization for retail demonstration.

To the fullest extent permissible by applicable law, HEVYMOTO, its directors, employees, and logistics partners shall not be held liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use our digital platform or purchased gear.

In all events, the total cumulative liability of HEVYMOTO for any claim arising out of a commercial transaction shall not exceed the actual monetary amount paid by the customer for the specific product at issue.

These Terms of Service are governed by and construed under the laws of the Republic of India. In the event of any legal dispute or arbitral proceeding, the courts of competent jurisdiction located in New Delhi, India shall possess exclusive jurisdiction.
